Show 7501 5480 you indicate where you it is rebuttal? MR. BLACKMAR: For instance, pages; 613 to 618, inclusive, deal with the LaSal mountains. MR. FARNSWORTH: I don't see anything there that rebuts any testimony given. THE SPECIAL MASTER: I can not rule now whether it rebuts it or not. It is offered for that purpose; if it does not rebut it, of course it is not relevant, but I can not bear in mind all the testimony on the subject. MR. BLACKMAR: It is an official document, anyway. MR. FARNSWORTH: That doesn't make any difference. We object to it as not rebuttal, and desire to reserve the right to make further objection when some point of it is pointed out. We can't stop to read it now, of course. I can't make a proper objection. There might be some section of it that would be rebuttal. I could stop now and examine it and make a proper record on it, of course, but if it is received so that when any portion of it is urged in the brief filled and in the argument at any later stage, they will indicate what part is claimed to rebut the testimony of the witness here, I would like to have the right to object to it at that time as not rebuttal. THE SPECIAL MASTER: It may be so received. |
