That was entirely introduced in this case. MR. FARNSWORTH: That was introduced in this case, your Honor, in response to his evidence. He put a great deal of evidence on with reference to depth of channel. Baldwin's testimony gave the draft of the boat, told about getting stuck, not being able to go on, and the testimony about other boats. Had witness after witness,-- I could almost say scores of witnesses as to depths, what kind of boat, what draft did you have, did you strike any sandbars, how far did it go up on your boat, and all that. Spent days with just that type of testimony. Part of his case in chief. We put in out case in response to that. If there is any testimony in this case which the witness can rebut,-- if one of our witnesses has said on a certain trip we did so and so, a certain thing happened, he might call a witness to refute that testimony as to that occurrence; but he certainly can not re- open his case and begin again on that matter of depths.
