BLACKMAR: Of course, the other testimony as to what took place on the trips which he made with Clarence Baldwin is clearly admissible in rebuttal; wouldn't be any dispute about that. MR. FARNSWORTH: Oh, yes, there is very grave ground for dispute, if you contend that you can go into those trips. Mr. Virgil Baldwin described all the troubles that he encountered. MR. BLACKMAR: I am talking about Clarence Baldwin. THE SPECIAL MASTER: If Mr. Clarence Baldwin testified opinion. MR. BLACKMAR: As to the trips which Clarence Baldwin took, I propose to show by this witness that he was with him on several different occasions when they were stuck on sandbars. I propose to show by this witness that when he was with Clarence Baldwin that there was not any two- foot channel in that river. That, to my mind, is clearly rebuttal testimony. As to the other testimony, as to his experiences on these other trips, that is entirely based upon the theory that Mr. Farnsworth has introduced into this case a two- foot channel, and it is offered for that purpose.
