Show 7509 Voorhees- D 5488 BY MR. BLACKMAR: Q The two boats which belonged to the Moab Carage Company, can you tell me the names of those two boats? MR. FARNSWORTH: If the court please, we object to this as not rebuttal; I don't think it is necessary to go any further as preliminary to any question he desires to ask that he claims is rebuttal. They went into the question of navigation, and all that sort of thing, as part of their case in chief. We put several witnesses on on that same question, in response to their testimony. Now, if there is any new matter that properly constitutes rebuttal, why of course I will not object, but I object to this question, and object to any further question until and unless it is shown in some way it is rebuttal, not a reopening of the case. I have let twenty witnesses go whom I could call as to trips on this river, merely because it was cumulative, didn't care to put in any more testimony on the subject. THE SPECIAL MASTER: Is this in relation to any issue which you already have put in evidence on on the part of the government? MR. BLACKMAR: As I understand the situation, Mr. Farnsworth has established a two foot channel in that river. I propose to show, among other things, by this witness, that there is no two foot channel in there. |
