In connection with the testimony of Mr. Zahn it is agreed that the photograph on the left- hand side of page 31, Exhibit 11 E, represents the site of the Zahn camp, seen from the north bank of the river; that the houses of the Zahn company were at the bottom of the bench which appears, and the boilers were at the bottom of the bench -- the pump. MR. OTTO ZAHN: The pumps were at the bottom of the bench. THE SPECIAL MASTER: That the mining operations were being conducted at the top of the bench. MR. OTTO ZAHN: Yes. THE SPECIAL MASTER: What is the approximate height of that bench above the river when you were operating? MR. OTTO ZAHN: I should judge about sixty feet. THE SPECIAL MASTER: That the top of the bench was approximately sixty feet above the level of the river at the time the Zahn were operating. ( Thereupon, at 5: 15 P.
