FARNSWORTH: We object to that as incompetent -- THE SPECIAL MASTER: I think that is competent. MR. FARNSWORTH: Let me finish my objection. -- calling for a conclusion of the witness as to whether he acted on it. THE SPECIAL MASTER: He knows whether he acted on it. MR. FARNSWORTH: There is no proper evidence in this record that indicates that, that he had any right to act on it, or that there was anything in the telegram that would be a proper basis for any action on his part. It is merely trying to prove indirectly what they can not prove directly. THE SPECIAL MASTER: Mr. Blackmar is not trying to prove the propriety or impropriety of the witness' action. He simply asked him whether, acting on the telegram, he desisted operations. MR. FARNSWORTH: We also object to it as irrele-vant and immaterial, so far as anything shown whether he acted on the telegram or not. THE SPECIAL MASTER: I overrule your objection and save you an exception. |
