Show 4011 Kane- C 2031 these rocks? A Yes sir. MR. FARNSWORTH: As I understand his testimony, your Honor, in response to your question, it was this, that he understood there were reefs which made it shallow; that is what he testified, that is what the other witnesses testi-fied, the presence of those reefs made it shallow. When your Honor asked him about these reefs, he volunteered that there were places then or fifteen feet wide in those reefs where the reefs were broken; he knows that such places existed, because he ran one or more boats through such places. I understand in the other places where there were shallow places and water running over them, where they had to pull and rock their boats over, he didn't give any inti-mation that he had to pull or work his boats through these breaks he later found in the reefs. THE SPECIAL MASTER: I didn't ask him one way or the other how he got through; I simply asked him whether there were these breaks. I understood later he testified he pulled the boat through. MR. FARNSWORTH: Not through those. I think the inference was unmistakable when he found those breaks, there wasn't any difficulty in getting boats through. THE SPECIAL MASTER: I didn't ask him how he got through. |
