S. Forest Service Forest Service Building Ogden, Utah Dear Sir: The Bureau of Indian Affairs has raised a question as to the withdrawal of lands for the Duchesne Administrative Site. The following-oescribed lands were withdrawn for that purpose on February 2, 1908, and are evidently part of the Stockmore Ranger Station Site: T. 1 N., R. 8 W., USM Sec. 19: SEtSEt; Sec. 20: SWtSWto The problem confronting the Bureau of Indian Affairs results from the division of lands between the two groups of Indians as provided in the act of August 27, 1954 (68 Stat. 868). Under that act the Affiliated Ute Citizens acquired the land in question, but, because of the withdrawal, the Secretary of the Interior is unable to give that group a clear title to the land as required by the act. In view of the requirement that the withdrawal of public land or the retention of lands in a withdrawal status be supported by a need for the land, it is requested that you give this matter your consideration. It may be that the land is no longer needed as an administrative site in forest management, or that an appropriate site can be provided .on land within the national forest boundaries. The latter appears qui~ possible as the land in question is only a mile or so to the south of the forest boundary. If the withdrawal is to be continued it must be supported by a justification. I am sure the Bureau of Indian Affairs will appreciate your early review of this withdrawal that appropriate action can be taken relative to the transfer of lands to the Affiliated Ute Citizens.
