Show 2. We would like these matters replied to in a specific, and site-related manner. Additionally, we would like to be provided information about problems or Issues which might stem from giving the Ute Tribal Council jurisdiction over fish and wildlife on all former Reservation boundaries in northeast Utah. We would be interested in problems related to the following issues, among others you foresee: - conflicts with the Forest Service mandate to manage and sustain wildlife, riparian ecosystems, and recreation resources under the Multiple Use - Sustained Yield Act and Forest Service Organic Act. - conflicts with wildlife management under conditions of wilderness classification areas. There might be a conflict of purpose. - probable costs, legal issues, and increased staff needs relating to monitoring wildlife, wilderness, wet meadow protection from ORV and snowmobile and loss of control over hunting/fishing timing and uses. - possible conflicts arising from as-yet-to-be determined exemptions on Reservation lands (Indian) from Water laws. There may be none. You will need to be specific in answering these. We would like to have an opinion, only, from Counsel to the Forest Service, on the legal priority between State and Indian wildlife jurisdiction and jurisdiction over Forest Service management of the habitat. Would this be based on time of authorization of entities, on constitutionally developed mandates, or on custom? Are there possible alternatives which might benefit Ute Indians, economically, from hunting and fishing, say, which would still leave management of the wildlife habitat and recreation resources under jurisdiction of the Forest Service? It is my understanding that this whole issue of wildife/fish jurisdiction was suggested to the Ute Tribal Council by Steve Boyden, Salt Lake Attorney for the Council. If this is true, it raises many questions of purpose. Thank you for your help in answering these issues.
