Ball if Fourth District Court, Utah County Provo, Utah 84601 Honorable Judge Ball if, \t 6 Re: Appointments to the Central Utah Water Conservancy District board The Citizens for a Responsible Central Utah Project is an organization of individuals and organized groups concerned with citizen representation and involvement in the Central Utah Project. We are writing concerning the appointments to the board of directors of the Central Utah Water Conservancy District. It is our understanding that seven board members are to be appointed in March by your court. Based upon past practice, it is our organization's view that all current members of the board who seek reappointment will be reappointed, despite the fact that some excellent alternatives will very likely be available. This occurred in 1979, when in our opinion some highly qualified applicants were available, in Utah County, in particular. We believe this practice serves to institutionalize special interests, and fosters "inbreeding" by avoiding exposure to outside inputs and approaches that could come from new appointees. We are aware that the Fourth District Court is required by law to appoint board members from 12 counties, only five of which are within the jurisdiction of the Fourth District. We are also keenly aware that the CUWCD has the power to tax. We believe that this method of appointment is an obvious example of taxation without representation, but at the present time this is the law. For these reasons reappointments must not be automatic to the CUWCD board. |
