Show this act, the commission may bring any legal action necessary in behalf or the employee to collect such claim for unpaid wages. The commission shall not be required to pay the filing fee, or The commission shall other oosts, in conneotion with such action. have power to join various claims against the employer in one cause of action. (5) In proceedings under this section, the district court other affirmative action as appropriate, including order may reinstatement of employees discharged in violation of this act. (6) The commission shall have power to petition any court of competent jurisdiction to restrain violations of section 2, and for such affirmative relief as the court may deem appropriate, including restoration of unpaid wages and reinstatement of employ ees, consistent with the purpose of this act. Court action under this act may be commenced two than later years after the cause of action, occurs. Section 5. no Section 6. Every employer subject to this act shall make, such z-ecorde or the wa.ges and 1age rates, job and maintain keep, other terms and conditions of employment of and classifications, the persons employed by him, and shall preserve such records for such periods ot time, and shall make such reports therefrom as the coss1on shall prescribe. Section 7. Every person subject to this act shall keep an abstract or copy of this act posted in a conspicuous place in or about the premises lhere1n any employee is employe.d. Employers shall be turn1shed copies or abstracts of this act by the state on request without charge. Section 8. (1) Any person who violates any provision or this act, or who discharges or in any other manner discriminates against any employee because such employee has made any complaint to his employer, the eomm1aslonJ) or any other person, or has instItuted, or caused to be il1Sti tuted any proceeding under or related to this act, or has testlf1ed or is about to testify in any such proceedingsp 1s guilty or a misdemeanor. ' (2) Any employer who violates this act by fa1ling to keep the records required hereunderl or to furnish such recorda to the con1ss1on upon request, or who falsifies such records, or who hinders, delays or otherwise interferes with the commission or its authorized representative in the pertoI1nance of his duties in the enforcement or this act, or refuses such official entry into any place of employment which he is authorized by this act to inspect, shall upon conviction be subject to a fine of not more than $500. Section 9. If any provision or this aot or the application or such provision to any person or circumstance 1s held invalid, the validity of the ,remainder or the act and the applicability of such provision to other persons or circumstances shall not be affected thereby. 3 |
