O'Connor Chairman, Board of Regents 710 Judge Building " Salt Lake City, Utah Dear Mr; O'Connor: On July 11 Mr. Wells Lo Barron, one of our night watchmen for the past six years, died. The following day he was to have begun his two-week vacation period which he earned in keeping with our rules and regulations. In checking the regulations regarding payment for unused earned vacation, it was learned that the University has no regulation to cover this situation, but rather it has been the policy over, the past several years to pay for the remaining days in the pay period in which death occurs. It other words, if a person dies near the first or the sixteenth of a month, he would get the benefit of an additional, pay period of two weeks‘ time. If, however, he passed away on the fifteenth or the thirtieth of the month, no additonal compensation would be made. In lieu of the practice which has been followed for some years in the past, it would seem much more equi- table to the employees, as well as to the University, if a policy were adopted which would permit payment to the beneficiary of the employee or his estate of earned vacation which had not been used by the employee at the time of his death, It would be appreciated if the Board of Regents would consider and adopt a new policy such as proposed to replace the procedure now in existence, . The suggested new policy conforms with the policies of the state government, and several large businesses which have formal personnel policies. Earned vacation, as contrasted with sick leave, is an earned credit due the employee and it is believed it would be only fair to pay to him for the benefit of his estate the amount of such leave which had been properly earned as a condition of his employment and not used at the time of his death. |
