Show Record judge I piloted that boat about 30 miles. I had never before piloted a boat on that river. I had never before in my life piloted a motor boat. Ella Ross testified on re- direct examination as follows: 4278 I was on the Cliff Dweller on one of its trips. I got on the boat at Little Valley about 7 miles below Greenriver. I went to the boat in a light row boat from Greenriver. We brought the Cliff Dweller in up rather high water. The water was very swift. 4282 Counsel for defendant stipulates with counsel for complainant that if George B. Bywater were called as a witness for complainant he would testify that he is a mining engineer employed by the United States General Land Office, that he has examined the records of Emery, Grand, San Juan, Wayne, Kane and Garfield Counties in the State of Utah, and that they disclose numerous placer locations made in pursuance of the mining laws of the United States commencing with the year 1895 down to the present time in the Green, Colorado and San Juan Rivers, and that said testimony should be limited to the bearing it might have upon 4284 the commercial aspect of the issue of navigability. Thereupon the Special Master ruled that the would admit the testimony in that respect only. Chris Halverson testified for complainant on direct examination as follows: 4285 I live at Greenriver, Utah. I have lived in and around 4286 Greenriver for a little over 40 years as a farmer and stockraiser. In the year 1889 or 1890 I helped to operate a ferry boat at Greenriver, during the high stage of water for three or four years. During the time that I was in and about Greenriver I do not recall any of the merchants in Greenriver receiving any merchandise by way of the river, but I wasn't taking any interest 4287 in the river traffic.
