Show 355 some witness who is familiar with those rivers? Mr. Collins: We are trying to get one; we have had a hard time in getting one. The Special Master: Those are four rivers which the United States Supreme Court has held, in some of their courses, to be non- navigable. Mr. Collins: It may be that I can get some Army man to take care of that. What are the rivers? The Special Master: The Supreme Court has held specifically that the Rio Grands north of El Paso is non- navigable. It held in the Oklahoma case that the Red River was non- navigable in the portions involved there. It held in a recent case, that I have forgotten the name of at the moment, that the Arkansas River was non- navigable; and then it held that the Platte River was non- navigable. I think it would be of assistance to have some one who is familiar with some of those rivers who might testify and compare the conditions. Mr. Collins: What was the second, the Red River? The Special Master: The Red River, in the Oklahoma case. The Arkansas has also been held to be non- navigable. I do not make that suggestion to have any controlling effect; but it occurred to me that it might assist the Court if we had some comparisons as to conditions on which it had made some specific findings on the rivers in question. 2320 |
