Show 358 The Special Master: In one of the Oklahoma cases, the Court has said that it is well known that the Platte is non- navigable. Mr. Blackmar: Was that in Judge Van Deventer's opinion? The Special Master: I do not know; but the other three are decisions where the Court made a ruling as to the navigability; one of them was the case of New Mexico, vs. Texas. The Court ruled that the Rio Grande north of El Paso was non- navigable. It also ruled in another case that the Snake River was navigable, but as I say, I do not recall as to what portion of the river it made that ruling. Are you through with Mr. Hoyt? Mr. Blackmar: I am through with him; yes, sir. Mr. Farnsworth: I am through with him. The Special Master: Were there any of my questions to Mr. Hoyt that either of you gentlemen object to? Mr. Farnsworth: No, I think they were very pertinent. Mr. Blackmar: There is no objection on the part of the Government. JOHN F. DEEDS, a witness of lawful age, called by and on behalf of the Complainant, having been first duly sworn according to law, by the Special Master, was examined and testified as follows: DIRECT EXAMINATION By Mr. Blackmar: 2323 |
