Show 252 expert. Mr. Farnsworth: There are a lot of those computations that may not be material. I do not make any objection to any pertinent tables there. If Mr. Hoyt says that they are correct copies, we will accept his statement as to that. I will say this, that as I scan that ( I have not had a chance to study it carefully), it contains a lot of excepts from other reports. They are arranged by Mr. Hoyt, and there are comments by him -- a sort of brief on the facts, apparently. I do not think that it is proper-- The Special Master: I do not think it is admissible so far as it contains that. I suppose, so far as it contains his personal observations on the characteristics of the stream and the surrounding country and the statement of what he himself did in making the survey-- of course, it is not strictly competent evidence, but I suppose it is presented in this form to shorten the examination. Mr. Blackmar: Exactly. Mr. Collins: Exactly. The Special Master: I should not think it is admissible over your objection. But, of course, it does shorten the examination very much. And I realize that you have not had an opportunity to study it sufficiently to cross examine him upon it. But I do not think, so far as it is in the nature of a brief, or a compilation of statements, that it ought to be 2215 |
