Show 247 has qualified, I think, as an expert on rivers. Mr. Blackmar: Well, is that satisfactory? Mr. Farnsworth: I would stipulate that he would testify that any conclusion there expressed is his opinion. Of course, there is so much in there-- he has probably expressed his opinion evidence. We can not possibly make an intelligent objection to such a vast offer as you have made. The Special Master: I do not see anything objectionable here ( indicating), Mr. Farnsworth. I agree with you that, on some matters it might be objectionable; but looking through here ( indicating exhibit) I see nothing on which he is not qualified to testify as an expert. The title of the report seems to represent what it consists of, and this is certainly on subjects that he is qualified to testify about, And if Mr. Blackmar wishes to ask him whether the conclusions and views there expressed represent his views, I think it is admissible. By Mr. Blackmar: Q. Mr. Hoyt, I ask you that question: If the matters embodied in there ( indicating exhibit) are your opinions as a hydraulic engineer, where an opinion is expressed, and the other matters are computations and calculations from records in the department? A. I doubt if I have any conclusion in there. It is just a compilation of data at the bas gauging stations which 2210 |
