Show 265 AFTER RECESS. The hearing was resumed at 2: 15 o'clock p. m. The Special Master: We are ready to resume. I think I will state, however, that I shall hold Exhibits 90, 91, and 92, the records of gauging stations at Bright Angel, Topock and Yuma, inadmissible as irrelevant-- certainly at this time. The issue is as to the navigability of this river in the State of Utah, and I can not see the relevancy of flood or river conditions below Lees Ferry. If later any ground shall be shown for considering them relevant, we can take it up then. But I do not consider those exhibits as relevant at the present time. Mr. Blackmar: Now, about Exhibit 86, you wanted to say something, Mr. Farnsworth. Mr. Farnsworth: Let me make an inquiry with reference to Exhibit 86; and the inquiry is pertinent to certain other reports that have been tentatively received in evidence. The Special Master: What are the reports? Mr. Farnsworth: ( continuing) Which reports were written by Mr. Hoyt; certain reports of Mr. Hoyt's. The Special Master: Well, the only other one about which there has been any question so far that has not been waived is the report, Exhibit 75. The others have gone in as accepted.
