Show 270 as the 1909 report is concerned, I have already stated that, unless the plans on which he bases his comparisons are produced, I shall disregard them, except so far as they relate to the work of Mr. Hoyt. I do not see, therefore, why you can not continue your cross examination of Mr. Hoyt now. Mr. Farnsworth: Oh, I am going to cross examine him; but I would like to circumscribe it somewhat, in view of counsel's statement. If that report is introduces, it will be necessary for me to go into certain matters with this witness, and I understand that the Government has not yet decided whether they are going to introduce the report. The Special Master: Well, I do not know that I can order Mr. Hoyt recalled for the purposes of cross examination. He is available as your witness. I suppose, as to the matter of cross examination, we ought to finish up with the witness now, should we not. Mr. Farnsworth: In the ordinary course, but it has been my practice before courts, even in the ordinary litigation, to give counsel considerable latitude as to recalling witnesses for cross examination. The Special Master: I think, as Mr. Hoyt is going with us, that may be permitted. Mr. Farnsworth: I would not wish to make an unreasonable request, but I have not been in any trial where that has not been permitted. 2233 |
