Show 266 1909 that has been referred to by Mr. Hoyt, many times, as well as by other witnesses, and which formed a part of the report of Mr. Hoyt; that is, it was the basis for a great many portions of his report-- The Special Master: ( Interposing) Do you mean the Army survey of 1909? Mr. Farnsworth: Yes. It seems to me that ought to be in. Now, we have waived objection to letting purported copies of reports go in. And I think, in view of what we have done in the way of waiving technical objections which might have been urged, doubtless with propriety, that report ought to go in. The Special Master: I do not see that the report has been referred to. Some of the surveys of 1909 have been used as comparisons, by Mr. Hoyt; and unless those are verified in some way later on in the testimony, I do not think that we can consider Mr. Hoyt's copy of that. So far as any report as a whole is concerned, Mr. Hoyt has neither used it nor referred to it. Mr. Farnsworth: I think it is in Mr. Hoyt's report. The Special Master: I mean that it has not come out in the testimony. Mr. Farnsworth: No; but he made mention of it a number of times, and doubtless based a number of his statement upon the statements found in that report, as to conditions found. 2229 |
