(4) 3 The cominission is authorized to endeavor to eliminate pay 4 practices unlawful under this act, by informal methods of conference, 5 conciliation and pursuasion, and to supervise the payment of wages 6 owing to any employee under this act. (5) 7 The commission shall have power to issue such regulations, 8 not inconsistent with the purpose of this act, 9 appropriate to carry out its provisions. Section 4. 10 (1) as it deems necessary or Any employer who violates the provisions of employee or employees af- 11 section 2 of this act shall be liable to the 12 fected in the amount of their unpaid wages, and in instances of wilful 13 0 14 15 violation in employee suits under subsection (2) of this section, up to an additional equal amount as liquidated damages. (2) Action to recover such liability may be maintained in any 16 court of competent jurisdiction by anyone or more employees for and in 17 behalf of himself or themselves and other employees similarly situated. 18 The court in such action shall, in cases of violation in addition to any 19 judgment awarded to the plaintiff or plaintiffs, allow a reasonable at- 20 torney's fee to be paid by the defendant, and costs of the action. 21 (3) No' agreement by any such employee to work for less than the bar 22 wage to which such employee is entitled under this act shall be a 23 to any such action, or to a voluntary wage restitution of the full amount 24 due under this act. 25 (5) At the written request of any employee claiming to have 26 been paid less than the wage to which he may be entitled under this 27 act, the commission may bring any legal action necessary in behalf of 28 the employee to collect such claim for unpaid wages. The commissio 29 shall not be required to pay the filing fee, or other costs, in connection 30 with such action. The commission shall have power to join various 31 claims against the employer in one cause of action. 32 33· (5) ;In. proceedings under this: section, the district court may: order other-affirmative .action "as appropriate', including reinstatemenf ':: |
