Show SNAKE RIVER COMPACT 313 Wyoming to any citizen of Idaho for any reason other than would apply to a citizen of Wyoming. "4. Citizens of Idaho shall have the right, by complying with the laws of Wyoming, to file upon and locate reservoir sites and storage basins within said 'Fall River Section' and to construct, build and maintain reservoirs upon said sites for storing the waters located and used as herein provided and to construct and maintain ditches and other diversion works within said area and to use natural streams to convey such stored water. "article hi "1. The following described area situate within Wyoming shall be hereinafter designated and referred to in this compact as the 'Teton Section' and when said words are used herein, they shall be construed as designating the area in Wyoming described as follows, to-wit: "Being the area bounded on the east by the crest of the Grand Teton Range; on the north by the south line of Township 46 North; on the west by the sfbate line between Wyoming and Idaho and on the south by the south line of Township 41 North. "2. Citizens of Idaho shall have the right by a compliance with the Laws of Wyoming to file application for and receive permits to appro- priate and use in Idaho any unappropriated and unused water in the 'Teton Section,' and also to locate and file upon unused reservoir sites in said section and to construct, operate and maintain reservoirs therein to impound such water and may construct and maintain ditches and diversion works to divert said water into Idaho and may use natural streams for such purpose. Provided, that as to any such im- pounded water citizens of Wyoming shall have the right to acquire and use not exceeding fifty percent upon giving notice prior to the commencement of the construction of said works to the parties in in- terest and by financing their proportionate share of the cost of con- struction, operation and maintenance of such reservoirs, ditches and other diversion works. "article iv "1. The area embracing the water shed of the South Fork of the Snake River, above the mouth of Salt River and including Salt River and the tributaries1 of each stream above the mouth of Salt River whether within the State of Wyoming or the State of Idaho shall be known and designated as the 'South Fork Section' and whenever in this compact the words 'South Fork Section' are used, they shall in- clude and be construed to mean all of said area. "2. That any unused and unappropriated water within said 'South Fork Section', whether the source of the same is in Wyoming or in Idaho, may be located, appropriated and used either in Wyoming or in Idaho, or in both of said states by citizens of either of said states and the respective states shall issue permits for such locations, diver- sion and use of said unappropriated and unused water in said section to citizens of either state, without distinction or discrimination.
