Show 312 INTERSTATE COMPACTS territories of the other state on the Snake River and its tributaries as hereinafter described, and to provide for the equitable apportion- ment, distribution and disposition of the waters of the said Snake River and its tributaries and to remove all causes of present and future controversy between them with respect thereto and between the citi- zens of one State against the citizens of the other State with respect to the said waters of the said Snake River and its tributaries, and being moved by considerations of interstate comity, have resolved to conclude a compact for these purposes and through their respective Governors have named as their Commissioners: "James B. True for the State of Wyoming and Frank Martin for the State of Idaho and the President of the United States having named R. F. Walter for the United States, the three forming a Commission for said purpose with full power to act therein, have agreed upon the following Articles, to-wit: "article i "1. The State of Wyoming and the State of Idaho are and shall hereinafter in this instrument be designated respectively as Wyoming and Idaho and the United States of America shall be designated as the United States. "2. Whenever in this compact the word 'citizen' occurs in connection writh the expression 'citizen of Idaho' or 'citizen of Wyoming,' the word is intended to mean and shall be construed to mean any person, persons, association, or corporation whose residence or principal place of business is in the respective state referred to. "3. The provisions hereof respecting each signatory State shall include and bind its citizens and all others engaged or interested in the location, diversion, use and distribution of the waters of the Snake River and its tributaries in the areas covered by the terms of this compact. "article ii "1. The following area situated in Wyoming shall be hereinafter in this compact referred to as the 'Fall River Section' and whenever herein that term is used, it refers to the area in Wyoming described as follows, to-wit: "Being the area in the State of Wyoming bounded on the East by the crest of the Grand Teton Range, on the North by the South line of Yellowstone National Park, on the West by the State line between Wyoming and Idaho and on the South by the South line of Township 46 North. "2. The physical conditions of the area in Wyoming designated as the 'Fall River Section' are such that the waters therein cannot be used in Wyoming for irrigation and domestic purposes, therefore the use thereof for such purposes upon lands in Idaho and the number and location of water rights, filings and permits and reservoir sites within said 'Fall River Section' shall not be restricted. "3. Citizens of Idaho shall have the right, by complying with the laws of Wyoming, to locate, file upon and receive permits for the appropri- ation of water within said 'Fall River Section' for use in Idaho and such location, appropriation, filing and permit shall not be denied by |
