Show 250 INTERSTATE COMPACTS "It is further agreed between the State of Texas and the State of New Mexico that when this Compact shall have been ratified by the Legis- latures of both States and approved by the Governors thereof, and the consent of the Congress of the United States shall have been given thereto, that the administration of this Compact shall be discharged by the respective officers of the States of New Mexico and Texas, au- thorized and empowered by the Governors of the respective States to administer the same, and that thereupon the request and agreement that the Secretary of the Interior should regulate and administer the Alamogordo Keservoir, in the spirit of the foregoing agreement, be withdrawn." Whether Texas' ratification of this agreement in the Act cited above included the final paragraph of the document is not clear from the text of the Act. The ratification was, in any event, repealed by its Act of May 28,1941 (Acts 1941, p. 637) "in order that the Attorney General of Texas may bring suit effectively against the State of New Mexico so that the State of Texas may get her proportionate part of the waters of the Pecos River * * *." |
