Show RED RIVER OF THE NORTH COMPACT 259 NOTES State ratifications.-Minnesota, Act of April 15, 1937 (Sess. L. 1937, p. 314; Minn. Stat. Ann. (1964), sec. 114.09). North Dakota, Act of March 10, 1937 (Sess. L. 1937, p. 506; N.D. Century Code 1960, sec. 61-17-01). South Dakota, Act of March 5, 1937 (Sess. L. 1937, p. 367; S.D. Code 1939, sec. 55.4901). Congressional consent to compact.-The consent of the Congress was given to the Red River Compact by the Act of April 2, 1938 (52 Stat. 150) from which the text above set out is taken. The Act also provided that nothing contained in the compact "shall be construed as impairing or in any manner affecting any right or jurisdiction of the United States in and over the Red River of the North and streams tributary thereto, or in regard to any of the matters covered by the said compact." Section 2 "expressly reserved" the "right to alter, amend, or repeal this Act * * *." See also section 5 of the Act of August 8, 1917 (40 Stat. 250, 256) whereby the Congress gave its consent to the States of Minnesota, North Dakota, and South Dakota, or any two of them, to "enter into any agreement or agreements with each other to aid in improving navigation and to prevent and control floods on boundary waters of said States, and the waters tributary thereto." This Act also pro- vides that "said States, or any two of them, may agree with each other upon any project or projects for the purpose of making such improve- ments, and upon the amount of money to be contributed by each to carry out such projects." |
