Show __2__ War Department, Washington. 20683. February 28, 1910. Dear Sir: Referring to the telegram which you left at the Department from W. H. Holabird, requesting, on behalf of the California Development Company, permission to construct a dam in Colorado River in the vicinity of that Company's intake, I beg to inform you that while the Colorado River is a stream the navigable portion of which lies within the limits of more than one State, and under the law authority should be obtained from Congress for the construction of a dam thereover, in view of the fact that the structure is intended only as a temporary expedient for the purpose of affording relief as soon as possible, the War Department will interpose no objection to the erection of the dam, as proposed, it being understood that the structure is temporary only in character; that the work shall be subject to the supervision of the district engineer officer stationed at Los Angeles, and that the dam will be removed by the company, at its own expense, within three days after notice from the Secretary of War to do so.
