It is calling for comparison, in the with any other river. I do not think if he answered the ques-tion, whatever his answer might be, it would give any guide on the facts. We would not know what the facts were which were at the basis conclusion; it is incompetent for the reason. It is irrelevant for the reason that if, as probably is the fact, there is not is any either river that is just like this -- if he answered " No", that he never knew of no such other river, it would not aid in this case; it does not affect the question whether this particular river is or not navigable. And whether there in any other river like it in the United States that is being navigated, I do not think that is relevant testimony. It certainly is not competent. |
