R. 139- 142) " The Witness: May I say a word, your Honor? " The Special Master: Yes. " The Witness: I would object to the report being called partisan and clever. It is a report on the con-didtion of the river between those two points. Now, It is in no sense a partisan report. It is a technical report on conditions as I found them." R. 142- 143. " The Special Master: Mr. Farnsworth, would not this meet your objection, that the report will be admitted, so far as it is a statement of fact, and in so far as it is a conclusion or a view expressed by Mr. Hoyt, such parts shall not be admitted; that those must be developed on oral examination? " Mr. Farnsworth: I think that would substantially cover it. I will go farther than that; that it may be admitted, in so far as it is a statement of the contents of other government reports and papers. It may be ad-mitted, in so far as it sets forth, or purports to set forth, a physical condition - " Mr. Collins: ( Interposing) of the river. " Mr. Farnsworth: ( Continuing) Seen by this witness on or off the river. Will not that fully meet the situation? " Mr. Blarkmar: That is all right. " Mr. Farnsworth: Any conclusions, or comparisons, or anything of that sort, we do object to. " Mr. Blackmar: All right." R. 143- 144. |
