Show Record Harry Aurand testified on cross examination as follows: 1362 It is about 40 miles from the oil location on the Elk Ridge I have just mentioned to the nearest point on the San Juan River. It is about 20 miles from the Elk Ridge district from the nearest point on the Colorado River. It is about 90 miles from the nearest point by water up to Moab. The country between the Colorado River and the place where this well was driven is extremely 1363 rough and rugged. There is no road between the well and the river. The altitude of the Elk ridge well is 7200 feet. The altitude of the Colorado River at the point nearest to the Elk Ridge well I would say was approximately 3800 feet. I continued to make my notations of difficulties in navigation after I passed Indian Creek, which was about 5 miles below the confluence, and I continued to make these observations with reference to difficulties until I had gone up the Green River to mile 34. My company never had any contracts or prospective contracts for drilling wells or other interests in wells over in the 1365 vicinity of the Green River. I continued noting difficulties because I found structures. I even put up notices of intention to make application for permit at several points below. I located the structures below Indian Creek between mile posts 11 and 7, in the gap between the two there is a notice on the Colorado. There is another one at mile post 2 1/ 2 on the Colorado River, and a third one on the Green River at mile post 32. Then on the Green River, up to where I saw this oil structure and then on up to where I turned around, I continued to 1367 note difficulties to navigation. The more oil structures I saw the more difficulties I noted. After I left Moab going on down to Indian Creek, than after I left Indian Creek going on down to the confluence and then on up the Green River, I was really interested in finding conditions that would indicate navigability as much as I was interested in finding oil structures.
