Show Record except in holes or depressions. 568 I have had occasion to observe the character of the river bed with reference to sand from Pogosa Springs, Colorado, down to Bluff City. We did not go up and down the river. There is no 569 road all the way to Pogosa Springs. I have not used the river for the purpose of bringing in or taking out goods. I have helped ferry people across with boats. I have never made a trip up or down the river in a boat. I have had considerable contact with the Indians there. The Indians have never run boats up and down the river to my know-ledge. Clinton W. Burnham testified on cross examination as follows: I could not fix the year when the river went dry. There 570 was more than one year. I cannot tell you when the other year was. It was between 1898 and 1990 when I last saw the river dry. I cannot remember the first time. I made a trip from Fruitland to Bluff City. I could not tell you when I made it. I have been down there several times by wagon road; once on horse back, following the road. James McEwen testified for complainant on direct examination 571 as follows: I am 73 years old. I live at present at Dolores, Colorado. I am a cow man and a hay raiser. I have been on the San Juan River all the way from Farmington to Aztec, Bluff City and 15 miles below Bluff City to Comb Wash. 572 I first came into that country in 1884. I had some horses at Comb Wash and came over to sell them. I sold them to white men, cow boys. I have run cattle from above Farmington down to the 573 Four Corners. I have never run cattle West of Bluff. I have crossed the San Juan below Bluff about 15 miles. I have seen the San Juan River when it was dry below Shiprock and above Bluff. I have never seen it dry below Bluff City. - 87- 1203 |
