THE SPECIAL MASTER: Well, of course, Mr. Farnsworth, I suppose so far as the material contained in the documents has a bearing on the issue, the documents themselves would be pertinent evidence, and if you have any objection to raise it would be to this form of proof. Of course this is an informal way of proving histori-cal documents, but of course the original documents, so far as they contain facts bearing upon the settlemtn of the regions now in question, or so far as they contain facts bearing upon the physical navigation of the river, of course that would be relevant evidence, and the only question would be as to this method of its proof. No, of course, I think you are entitled to examine the document carefully before any final ruling is made on that. MR. FARNSWORTH: I think there has been pretty much of an understanding between counsel in this case that we do not raise objections based upon the ground it is not the best evidence, that they are copies. I do not expect to make such an objection. know whether they are historical documents in the first place. |
