S . 574y 591 , where , after arriving at the ( conclusion CODclusion ) of nonnavigability of the Red River , this Court said : - We conclude that no part of the river within ( Oklahoma 01dahoma ) is navigable and therefore that the title to the bed did not pass to the State on its admission into the Union . Prior to the statehood of Utah , the United States owned all of the present State of Utah , including the beds of all streams , except such lands as the United States had disposed of . If the title to the beds of the Green , Colorado , and San Juan rivers did not pass to the State of Utah upon its admission into the Union , the ownership of the river beds remains in the United States . It follows that the United States is entitled ( to" to ) the relief sought . The Exceptions filed on behalf of the United States of America should be sustained . A decree should be entered . in accordance with the prayer of the bill of complaint , adjudging and decreeing that the United States of America holds the full and exclusive fee simple title in and is entitled to the exclusive use enjoyment and , , possession of said river beds , and every part thereof , as set forth in paragraph II of the Bill of Complaint , except the lands mentioned in Exhibit A , attached to the bill , and that the State of Utah be forever |
