Description |
Testimony given before special master Charles Warren in a suit brought by the United States against the state of Utah over ownership of the bed of the Colorado River. Much of the testimony was given by river runners, scientists and engineers, petroleum geologists, and placer miners. The testimony constitutes an extensive oral history of the men and women who utilized the Colorado River Basin in Utah prior to 1929. |

Show 76 the use which any person may lawfully make of such waters is limited to such incidental right of floatage or qualified navigation , . ( p . . p . 716-717 ) On certiorari to this Court , , the judgment of the Court of Appeals was affirmed . . ( See ( McKce 1111clCee ) v . Gratz , 260 U . S . 127 . ) Court disposed of the ( ques- ques ) tion of navigation by saying ( p . 136 ) : : * * * We about say nothing the ( char- char ) acter of the stream as to navigability . . The jury at least might find that there was nothing in that to prevent the application of what we have said . We are slow to believe that there were public rights extending to the removal of mussels against the ( landowner's landowners ) will . It will be noted in the above opinion of the Court of Appeals that there was a limited use by the public of the river for the floatage of small boats and some commercial navigation . But this Court held that such limited operation of boats was not sufficient evidence to constitute the stream navigable in law and in fact . In the case of Toledo Liberal Shooting Company v . . Erie Shooting Club , 90 Fed . 680 , the commercial aspect was given serious consideration . It was ( possi- possi ) ble to operate canoes and ( flat-bottomed flatbottomed ) ducking boats in the pursuit of ducks and other water fowl . .
