The State of Utah , in pursuance of its assertion of ownership has , during the past few years , granted oil and gas leases to certain portions of the beds of the rivers , and in the year 1927 passed a Legislative Act declaring the rivers to be navigable . ( See Laws of Utah , 1927 , page 8 , Brief , page 94 . ) By order duly entered March 11 , 1929 , Charles ( Warren Warreti ) , of Washington , D . C . , was appointed Special Master with the powers of a Master in Chancery , to take the evidence and to report the same to ( this -this this ) Court , with the findings of fact , conclusions of ( law liiw ) and recommendations for a decree , all subject to examination , consideration , approval , modification , or other disposal , by this Court . . The Master filed his report herein on the 15th day of October , 1930 . The Master ( M . R . 182 ) found the Green River , the Colorado ( Grand ) River from Castle Creek to the Junction with the Green , and the Colorado River from Mile 176 above Lees Ferry to the ( Utah-Arizona UtahArizona ) boundary to be susceptible to navigation . To these findings the Government filed exceptions . The section of the Colorado from the Junction with the Green to Mile 176 , the Master found to be not susceptible to navigation . To this finding Utah filed exceptions . The Master found the San Juan River to be not susceptible to ( naviga naviga- naviga ) ¬ tion . To this finding neither party filed exceptions . |
