Show 6868 Wimmer- RD 4857 in fact, I know it is a little steeper, more cataracts; there is not a cataract from the San Rafael to the junction of the river; there is no such a thing as hardly a riffle in the whole distance. Q Would you think, with a proper powered boat, there was any difference in the practicability of navigation between them? MR. BLACKMAR: I object to that as calling for a conclusion of the witness, not specifying the king of proper powered boat. THE SPECIAL MASTER: I think you better confine it to the type of boats he had used. I confined my question to that. I think we get further if we take the witnesses on their actual experience. I don't know that man, or some of the other men, would know about running other kinds of boats. But they do know about running the boats they have run. I think we get a great deal further for a practical knowledge of these rivers by not going into theory. MR FARNSWORTH: Of course, my thought is this, your Honor, that he may not have had the same typeof boats in the two places, he has seen them on water that is substantially the same. |
