Show 145 The special Master: I should think the diary would be goin pretty far away, unless it is the field notes on which he was basing his report. Mr. Farnsworth: Well, is there any such thing as that that I have stipulated that is in the diary and not in the record? If there is, i think you ought to call attention to it; because I know that that diary wanders quite a little, and the style is quite different. Mr. Blackmar: Well, it is really more than a diary of Mr. Hoyt's: It is really a part of his field rotes. Of course, there are certain thins such as this walk that they took from the San Rafael to the Green River. Mr. Farnsworth: Is there any fact that has a proper bearing on this case that is in there that is not in this report? Mr. Blackmar: I do not think there is. Mr. Farnsworth: Then I do not think the diary ought to go in. By Mr. Collin: Q Is there? A No, I do not think there is any physical fact relative to the physical characteristics of the river that is in the diary that is not in the report. The special Master: I think that is merely an accumulation of evidence. Mr. Blackmar: Very well. We will withdraw Exhibit No. 76, 2106 |
