Show 5 Mr. Farnsworth: It is hereby stipulated that the prayer contained in defendant's answer is intended, and shall for all the purposes of this case, be construed to include, and be considered and treated as including, the prayer that the de-fendant be adjudged and decreed to be the owner of all of those portions of the beds of the Colorado, Green and San Juan Rivers mentioned in subdivision No. 2 of complainant's bill of complaint. herein. I think that the prayer is probably inclusive of that, but we just want to put it beyond controversy. The Special Master: You say it is so stipulated? Mr. Farnsworth: Yes, sir The Special Master: Stipulated with the defendant? Mr. Farnsworth: By and between the parties to the action Mr. Blackmar: We have not any objection to Mr. Farnsworth amending his pleading to include that, or, as he states, the pleading can be treated as including that-- either way he wants, to do it. I think, as I told you out there, Mr. Farnsworth, that your general prayer for relief will grant you what you want. Mr. Farnsworth: I have no serious doubt that it does.
