Show 35 Mr. Farnsworth: I want to object to each separately. I object to the offer of Exhibit 13, on the ground that it is incompetent for any purpose. It purports merely to be a volume entitled, " The Romance of the Colorado River," by some one whose present whereabouts are not accounted for at all, and it is merely the story of such person-- hearsay. We object to it separately, upon the ground that all portions of the book relating to points outside the territory in controversy in this case are irrelevant. The Special Master: Well, so far as this witness is concerned, his testimony is merely offered now to identify these photographs, I understand, as being an accurate depiction of what he himself saw. Mr. Farnsworth: As to any photographs which are in that book, we do not object to their gong in where the witness shows that they are fairly representative, provided they represent points whose physical condition or appearance is relevant to any issue in this case. Mr. Blackmar: Well, the title page of this book contains this statement, " The Story of its Discovery in 1540, with an Account of Late Explorations, and Wish Special Reference to the Voyages of Powell Through the line of the Grand Canyon." Now, it will appear in evidence later on that the Powell expedition was an official expedition. And incases of this kind historical works are recognized as evidence. That is 1996 |
