Show Director, the District shall return to the United States the balance, if any, of the funds advanced pursuant hereto which have not been spent for the purposes for which such funds have been advanced. Any balance of funds so returned to the United States pursuant to this subdivision of this article shall be applied in reduction of the loan obligation of the District as stated in Article 9(b) hereof. Acquisition of Rights of Way 5. "Where, in the opinion of the Secretary, the use of lands, easements, rights of way, and other interests in land are required for the construction, operation and/or maintenance of the works and structures described in Article 4(a) above, and such lands, easements, rights of vay, and other interests in said lands are not reserved to the United States under Acts of Congress or otherwise, or the lands over which such easements, rights of way, and other interests are required are not then owned by the District, the District shall, upon request of the Contracting Officer or his representative, acquire title to such lands, perpetual easements, rights of way or other interests in said lands situate in the State of California required for such purpose, and in turn convey unincumbered fee simple title thereto or perpetual easements therein to the United without cost to the United States. States/^ All interests in lands ov,ned by the District which are required by the United States for the purposes set out herein shall be made available by the District to the United States when so required, without cost to the United States. 11 |
