HoLABIRD, ) as commissioner ) ) to ) ) Southern Pacific Company ) a corporation ) This Indenture, dated this 23rd day of February, 1916, between W. H. Holabird, as commissioner under and by virtue of a decree of foreclosure and order of sale hereinafter more particularly referred to, party of the first part, and Southern Pacific Company, a corporation, organized and existing under the laws of the State of Kentucky, party of the second part, Witnesseth : That under and by virtue of the decree of foreclosure and order of sale issuing out of the Superior Court of the State of California in and for the County of Los Angeles, on the 27th day of December, 1915, in an action wherein the Title Insurance and Trust Company, a corporation, was plaintiff, and the California Development Company et al., defendants, and Boaz Duncan, Intervener, said action being number 81926, the said party of the first part was appointed commissioner for the purpose of selling the properties in said action decreed to be sold, and that pursuant to such decree of foreclosure and order of sale and after notice thereof in accordance with law, the party of the first part did offer for sale the properties hereinafter described as an |
