Show -13- In Public Law 60, 78th Congress, Chapter lOij.-First Session, approved May 26, 19U3* Section 2 of the Act, following Section 1 providing for the assent of Congress to the Compact, provided* "Sec. 2 (a) In order that the conditions stated in article XI of the compact hereby consented to shall be met and that the compact shall be and continue to be operative, the following provisions are enacted--" (There then followed the stipulations as to recognition of the rights and interests of the states to the beneficial consumptive use of water as set forth in Article XI of the Compact.) Precedent supporting the power of Congress to* effectuate provisions of Article XI of this Compact is ample. The Boulder Canyon Project Act approving the Colorado River Compact contained many provisions defining and fixing the powers of the federal government with respect to the operation of that Compact. Although the particular formula adopted by the Republican River Compact may not be fully applicable in other basins, yet with appropriate adaptations it would meet the conditions present in other river basins and serve to avert the clash between federal and state jurisdictions. Already this formula has been followed by the Belle Fourche Compact between Wyoming and South Dakota now before the Congress of the United States for approval. |
