(2) Kentucky and Tennessee Boundary Compact of 1820: (a) Congressional assent was given by Resolution of May 12, 1820.-55 (b) Commissioners were appointed at various intervals by both States during the period of 1801-1820 in an attempt to secure a settlement of'the boundary line favorable to both States.56 By the Act of November 23* 1819*57 the Tennessee Legislature appointed two commissioners with author- ity to enter into a binding agreement with Kentucky. By the Act of Jan- uary 1, 1820 5^ Kentucky appointed commissioners to negotiate an agreement to be submitted to the legislature for ratification. The agreement thus concluded, after slight modifications to comply with the request of the Kentucky Legislature, 59 was ratified by that State by the Act of February 11, 1820. 0 (c) This compact was considered in Poole v. Fleeger (1837 U» S.) 11 Pet. 185, affirming Fleeger v. Poole (1832) Fed. Cas. No. 4860. (3) Incorporation of C* & 0. Canal Company in 1825* (a) The requisite Congressional assent for the incorporation of the Company was given by the Acts of March 3, 1825, 61 May 23, 1828,62 and July 14, 1832. 63 (b) By the Act of January 27, 182i+,64 Virginia incorporated the C. & 0. Canal Company with the privilege of exercising the right of eminent domain, 55 3 Stat. at L. 609. 56 Commissioners were appointed by Tennessee on Nov. 3» 1803• See I Scott, Tenn. Laws* ch» 63f p. 801. The so-called 'Walker's line was then, run and confirmed by Tennessee with a request that Kentucky should do th.e same, on Oct. 21, 1812. See 2 Scott, op. cit. ch. 61, p« 91. Kentucky had appointed commissioners on Dec. ll+, 1801. See Tomlinson, Coll* Ky. Acts, Ij.81. But on Deo. 22, 1802, Kentucky repealed this act. See 3 Littl. Ky. Laws, ch» 37* P« 80. Commissioners were again appointed on Feb. 1+, 1812, to act with the Tennessee commissioners. See Ky. Laws, 1811, 188. Kentucky refused to accept Walker's line, but sought to secure a settle- ment by continuing negotiations with Tennessee. See Ky.
