Show are not, by the terms of the agreement, to preclude extension of irrigation within certain further limits, provided t'hat the volume of water used is not increased. It is agreed that each Government is at liberty to construct reservoirs and other works within certain limits, provided that the impound- ing of water therein does not diminish the. supplies to v/hich each Government is entitled under the agreement, nor affect the diversion of the surplus water which it is-expected will be available for diversion upon the termin- ation of the agreement? By article I of the convention between Hungary and Roumania regarding the hydraulic system of the coterminous territories, etc., signed at Bucharest, on April 11+, I92J4, it was provided: "The High Contracting Parties undertake, in conformity with the provisions of Article 292 of the Treaty of Trianon, to refrain from taking any unilateral aotion which might have an adverse ef- fect on the hydraulic systems of the adjoining districts, or undertaking any works likely to modify existing conditions in a manner unfavourable to the other Contracting Party." ij.6 League of Nations, Treaty Series, p. lj-3. By article II of the convention signed by the United States and Canada, on February 2i+, I925, concerning the regulation of the levels of the Lake of the Woods, it is provided 1 "The level of Lake of the ?/oods shall be regu- lated to the"extent and in the manner provided for in the present Convention, with the object of se- curing to the inhabitants of the United States and Canada the most advantageous use of the waters there- of and of the waters flowing into and from the Lake on each side of the boundary between the two countries for domestic and sanitary purposes, for navigation purposes, for fishing purposes, and for power, irri- gation and reclamation purposes." The tireaty between France and Germany regarding the delimitation of the frontier, signed on August II4, 1925, provided in article 13i "No modification may be made either in the course or in the classification of the roads,, canals and non-navigable watercourses forming the frontier, and no construction of or material alternative in weirs, installations or buildings liable to modify the flow of water may be under- taken without previous agreement between the High Contracting Parties." |
