Description |
Testimony given before special master Charles Warren in a suit brought by the United States against the state of Utah over ownership of the bed of the Colorado River. Much of the testimony was given by river runners, scientists and engineers, petroleum geologists, and placer miners. The testimony constitutes an extensive oral history of the men and women who utilized the Colorado River Basin in Utah prior to 1929. |

Show ( ft-oinbaing ftoinbaing ) used as a highway 14 of ( commerce coi-limarce coilimarce ) as ( de- de ) fined in the cases cited , are an erratic or ( undepend- undepend ) able stream flow ; ( an all ) excessive ( quantity qiiantity ) of sand and silt and other ( materials iiiaterials ) in ( suspension suspeusion ) ; a steep gradient ( which ivhich ) produces high velocities of stream ( floiv- floiv ) many rapids ; shifting sand bars ; ( instability unstability ) of ( channel chailliel ) ; marked sinuosity of the channel ; and ( terrain termin ) immediately adjacent to the river of a ( char char- char ) ¬ acter which permits a rapid ( run-off runoff ) ( from froin ) rains and thereby subjects the river to sudden and ( un- un ) usual floods . As will be pointed out in more detail in this . brief , all of these ( natural iiatural ) conditions offering ( ob- ob ) structions and interference to navigation are ( pres pres- pres ) ¬ ent to a marked degree on the Green , Colorado , and San Juan rivers . Some of the ( obstructions obStTUCtiOlIS ) of the ( character chapacter ) ( men men- men ) tioned have been the subject of comment by ( the the- the ) Supreme Court of the United States , and ( consid consid- consid ) ered by that Court to create sufficient interference with the operation of boats to render the ( river Tiver ) ( non- non ) navigable . By a parity of reasoning , those ( ob- ob ) , structions to the operation of boats which have not already been ( commented comnieiited ) on by the Supreme Court of the United States and which are present in the rivers in question are of such a character that they have in the past , do ( now iiaxv ) , and will in the future ( pre- pre ) vent any use of the rivers in their natural and ( ordi ordi- ordi ) ¬ nary condition as highways of commerce over which trade and travel may pass in the ordinary ( and and- and ) customary modes . |
