Description |
Testimony given before special master Charles Warren in a suit brought by the United States against the state of Utah over ownership of the bed of the Colorado River. Much of the testimony was given by river runners, scientists and engineers, petroleum geologists, and placer miners. The testimony constitutes an extensive oral history of the men and women who utilized the Colorado River Basin in Utah prior to 1929. |

It is evident from this clause ( tliat that ) the State of Utah declined to assume any responsibility in maintaining the validity of the leases , and , hence , also the ( navigability navigablility ) of the streams . That ( litiga litiga- litiga ) ¬ tion was cast upon those ( who NIio ) accepted the State leases . Intrastate navigable ( streams streanis ) are charged with a servitude in favor of the public , and the ( ob- ob ) ligation rests upon the State to ( maintain i-naintain inaintain ) the ( in- in ) tegrity of that servitude for the benefit of the ( pub pub- pub ) ¬ lic who desire to navigate the streams . A ( navi navi- navi ) ¬ gable stream presupposes a ( highway Idghway ) of commerce , valuable to the public for the purposes of ( transpor transpor- transpor ) ¬ tation , and Utah has not ( claimed claft-ned claftned ) that use for the rivers in the past . By its attitude it has denied that the use existed ( , . ) Navigability of the rivers should be asserted for the primary purpose of ( es- es ) tablishing the rivers as public highways of ( com coim- coim ) ¬ merce . In order to sustain its position , Utah in 1927 enacted the following law ( Laws of Utah , 1927 , page 8 ) : SECTION 1 . Colorado River in Utah and Green River in Utah declared to be ( navi navi- navi ) gable streams .
