FARNSWORTH: Now, Mr. Blackmar, you were proceed-ing to state in substance that a witness had appeared here who had testified -- you said witnesses had appeared here who had testified -- MR. BLACKMAR: One witness had appeared here who has testified there were certain lands in and about Moab which were subject to being irrigated and reclaiming in various ways. Now, of course, the witness who testified was a lay witness, and not shown he had any qualifications for that. What he had to say on it was, of course, a bare conclusion. So that in this case from start to finish there has been the question of the character of the land. THE SPECIAL MASTER: I understand your position. I whether this is the best way of proving the facts as to the irrigability of the land. I will look the exhibits which have been offered over. I assume, in view of your statement, as a part of the official duty, that you will produce some witness who will testify as to that. The documents do not speak for them- |
