Show 8 1 shall deem proper to open for entry, such portion of said 2 lands shall be opened to entry in tracts, varying in size, 3 but not exceeding one hundred and.sixty acres, as may be 4 determined by the Secretary of the Interior, in accordance 5 with the provisions of the reclamation law, and any such G entryman shall pay the proportionate share, as determined 7 by the said Secretary, of the construction cost of the canal 8 or canals and appurtenant structures, constructed for the 9 irrigation and reclamation of said lands, as provided for by 10 this Act, such construction cost to be paid in such instnll- 11 ineiitx, and at such times as may be specified by the Sec- 12 rotary of the Interior, in accordance with the provisions of 13 the said reclamation law: Provided. That all persons who 14 have served in the United States Army, Navy, or Marine 15 Corps during' the war with (leniiany, the war with Spain, 16 or in the suppression of the insurrection in the Philippines, 17 and who have been honorably separated or discharged there- 18 from or placed in the Regular Anny or Navy Reserve, shall 19 have the exclusive preference right for a period of three 20 months to enter said lands; and also, so far as practicable, 21 preference shall lie given to said persons in all eonstrue- 22 tion work authorized by this Act: Prodded, That in the 23 event such an entry shall be relinquished at any time prior 24 to actual residence ujmn the land by the entryman for not 25 less than one year, lands so relinquished shall not be sub- |
