BLACKMAR: I object to that as calling for a conclusion of the witness; purports to be a hypothetical question, and it is not based on any facts which are in evi-dence here; it is purely speculative. MR. FARNSWORTH: I don't know what counsel means by a hypothetical question; there is no hypothesis in it. MR. BLACKMAR: The hypothesis is, you have a good road down there. THE SPECIAL MASTER: I think the question is objec-tionable, Mr. Farnsworth, when you put in the added factor that you did put in, that is, the possible making of a good road. I don't see how this man or anybody could testify beyond what he has already testified to as to what would be the comparative ease or difficulty if there was good road down there. I understand from all the testimony there is not a good road down there, that the country is very badly broken up, and I don't think that even if I allowed this witness's answer to your question that it would mean much, if I learned what would be the conservative difficulty if there were a good |
