Show 7062 Baldwin- D 5043 jection? MR. BLACKMAR: As far as this witness is con-cerned, this is purely hearsay; it is not competent testimony. I make no objective to the document whatever on the ground that it is not probably identified, but it simply is not com-petent evidence of the fact that are therein recited; no way to prove the fact. MR. FARNSWORTH: I am not going to take any chances on any objection that counsel has urged, and will go through this diary item by item with the witness unless counsel waives that objection. MR . BLACKMAR: What objection is that? MR. FARNSWORTH: Unless you will stipulate the witness, aided by this document, will testify that these trips were made on the dates as indicated in the diary, I will go through the entire diary with the witness. If you will stipulate that he will so testify, why, then I will not do so. If you will stipulate he will so testify and permit the diary to go in as a record of those dates, subject to your other objection. You can make any other objection on your care to. My though is, I don't care to offer this as a document as original |
