Are you willing to stipulate as to each of those recollection would be refreshed so he could give the dates, and that those dates are as set forth in this diary, and that the copy of the diary may be received in evidence merely as to the respective dates and trips therein stated, all material in the diary with reference to tonnage or troubles down the river, hearsay matters, to be not considered, but merely use the diary to fix the identity of those trips and their dates? MR. BLACKMAR: I do not admit the truth of the entries in there, but I admit the witness, if interrogated about it, would testify that his memory was refreshed, that is, that he would say that boat made the trips on the dates therein specified.
